Information provided in accordance with current legislation on the protection of personal data (EU Regulation 2016/679 – GDPR).

1) Purposes of processing and legal basis

Your personal data will be processed for the following purposes:

• maintenance of the register of members and related activities;
• the creation and updating of the mailing list (name, address and any other contact details) for the dispatch of corporate communications and documentation;
• accreditation and registration for attendance at the Company’s general meetings;
• recording and minuting of speeches and votes at general meetings;
• payment of dividends;
• the exercise of the right of withdrawal or of any right for which, under the law, prior authorisation from the issuer is required.

In addition to the purposes set out above, the aforementioned data may be processed in order to comply with obligations laid down by law, regulations or EU legislation. The collection of your data is therefore necessary and/or required by law for the purposes set out above: failure to provide such data, or providing it only partially or inaccurately, could result in the incorrect fulfilment of these obligations.

2) Retention periods

Ecosuntek S.p.A. retains your data for the period specified in the company policy and, in any event, for a period not exceeding that required to fulfil the purposes for which it is collected or subsequently processed, as well as for the period required by law for administrative purposes, for the handling of any complaints or disputes, or for criminal law purposes.

3) Methods of processing

The processing is carried out manually and/or using IT and telecommunications tools, in accordance with procedures related to the purposes set out above and, in any event, in such a way as to ensure the security and confidentiality of the data.

4) Data Controller and Data Protection Officer

The data controller is Ecosuntek S.p.A., with its registered office at Via Madre Teresa di Calcutta snc, 06023 Gualdo Tadino (PG).

5) Categories of recipients

In addition to employees of Ecosuntek S.p.A., certain processing operations may be carried out by third parties to whom the Company entrusts activities and services for the purposes set out in point 1). These parties, which may also be based in EU countries, will act as independent Data Controllers or Data Processors and fall into the following categories:

• Members of the Company’s Board of Directors and Board of Statutory Auditors;
• Companies or individuals appointed to send corporate material;
• Companies or individuals responsible for the management and maintenance of information systems;
• Audit Firm;
• Companies/service centres responsible for entering the data required to update the register of members;
• Professional firms or independent practitioners providing advice and assistance with corporate transactions and the organisation of the general meeting;
• Public institutions and/or authorities (courts, the Stock Exchange, Consob, etc.) in order to comply with specific legal obligations;
• Credit institutions for securities transfers and banking instructions (e.g. dividend payments);
• Organisers of calls for proxies for attendance at general meetings, in the cases provided for by law.

Certain personal data may also be disclosed to the financial markets in accordance with current legislation and CONSOB regulations.

6) Rights of the data subject

You have the right to access your personal data at any time and to exercise the other rights provided for by law (source of the data, rectification, restriction, erasure/right to be forgotten, data portability, objection to processing on legitimate grounds) by sending an email to info@ecosuntek.it or by contacting the DPO at the following address mario.manganelli@protendo.it. You also have the right to lodge a complaint with the Data Protection Authority.
